| Abstract | Resumo Este artigo trata da clássica relação entre as ordens moral e jurídica, no contexto problemático do direito contemporâneo, acentuado pela crise nos países ocidentais do Estado constitucional. O autor defende a necessidade da relação entre o conhecer e o agir no direito, ou seja, de afirmar a relevância de uma unidade autêntica e coesa entre a teoria e a prática jurídicas. Por um lado, a coerência jurídica deve estar baseada no rigor lógico, por outro, essa coerência exige o compromisso e a responsabilidade dos agentes jurídicos. Portanto, neste artigo é sugerida a necessidade de um compromisso verdadeiro com os fins próprios do Direito e, ainda, que a responsabilidade se converta em condição ineludível para, juridicamente, saber distribuir com justiça. Palavras-chave : corrupção e regeneração democrática, direito e moral, lógica jurídica, relação analógica, saber prático, virtudes e actos Jurídicos Abstract This article deals with the classical relations between moral and juridical orders, in the problematic frame of contemporary Law, marked by the current crises, in western countries, of constitutional State. The author argues for the necessity of a relationship, in Law, between knowing and acting, that is, the necessity of affirming the relevance of an authentic and cohesive unity between theory and juridical practice. On the one hand, the juridical coherence must be based on logical rigor, on the other, that coherence requires the commitment and responsibility of legal agents. So, in this article it is suggested the need for a genuine commitment to the purposes of Law and, also, that the responsibility becomes the unavoidable condition to know, legally, how to distribute with justice.
