  Abstract	Resumo A crise social e económica produziu uma crise de legalidade. Face a esta situação, colocaram- se na linha da frente os princípios e os valores, entre os quais se destaca a justiça. O novo constitucionalismo tende a dar transcendência, não só ética, mas também jurídica, a verdades que antes apareciam como meramente inspiradoras do direito. Surge a abordagem da justiça como drama, como protagonista da decisão na aplicação do direito. Neste sentido, o direito aparece como algo passível de ser desconstruído, transformado. Por outro lado, a justiça, distingue-se do direito por não poder ser desconstruída; a justiça é a desconstrução, a razão de ser da desconstrução do direito. Não obstante, a justiça, que é vontade, sentimento e desejo, necessita do direito como elemento calculador, normativo e de vigência. Há um futuro para a justiça, símbolo da dignidade e da liberdade no argumento da pessoa. Considering this situation, principles and values have been placed at the front line, among which justice must be highlighted. The new constitutionalism tends to give transcendence, not only ethical but also legal, to truths that used to appear as merely inspiring law. An approach of justice as drama arises, as a protagonist of the decision on the enforcement of the law. In this sense, law emerges as submitted to deconstruction, to transformation. On the other hand, justice differs from law in the sense that it cannot be deconstructed; justice is deconstruction, is the raison d’être of the deconstruction of law. However, justice, that is will, feeling, and desire, requires law as a normative, calculating and validating element.
