  Abstract	Resumo O momento atual vivido pela teoria jurídica, no qual se avulta a relevância dos direitos fundamentais de base constitucional e sua influência na compreensão e aplicação do Direito, impõe um diferente papel para a hermenêutica, a qual se apresenta como uma ciência que oferece os mecanismos para colocar em marcha o processo de atualização das normas, adequando- as ao horizonte constitucional. O presente artigo analisa o processo interpretativo a partir da concepção de Gadamer acerca da ciência hermenêutica, destacando o papel ativo desempenhado pelo intérprete na construção das normas jurídicas. Palavras-chave : Constituição, direitos fundamentais, Gadamer, hermenêutica Abstract The present moment of jurisprudence, in wich grows the importance of fundamental rights of constitutional basis and its influence in the understanding and application of Law, demands a different role for hermeneutics, wich presents itself as a science that offers the instruments to set in motion the process of rules updating, adjusting them to the constitutional horizon. This article analyzes the interpretive process from the Gadamer’s conception of the hermeneutical science, highlighting the active role played by the interpreter in the construction of juridical norms.
