    Abstract In this article, we present the controversy surrounding the universal right to education within the conceptions of justice as a just entitlement, advocated by Robert Nozick, justice as rules of good conduct, supported by Friedrich Hayek, and justice as fairness, developed by John Rawls. When education is provided by the state, state taxation violates the freedom of citizens to freely enjoy their property. Therefore, in the theories of justice as a just entitlement and rules of good conduct, there is no universal right to education. On the other hand, the theory of justice as fairness not only defends the universality of this right but also advocates for its pivotal role in human development. However, by expanding the scope of education to encompass human development, the theory of justice as fairness encounters certain difficulties. Without taking a stance among these numerous conceptions, we leave open the consequences of rejecting the universal scope of the right to education and understanding education as a means of human formation.
