| Abstract | Resumo Com o princípio da igualdade pretende-se, que seja reconhecido a todo o ser humano, os direitos que lhe são inerentes, independentemente das suas características pessoais. Por outro lado, o princípio da identidade salienta as diferenças distintivas entre as pessoas. Todavia, é perigoso opor estes dois valores, porque a sobreposição da igualdade contra a identidade (marxismo), ou da identidade contra a igualdade (nazismo), tem conduzido à barbárie. Por conseguinte, para ultrapassar esta tensão e articular a liberdade de cada um com a igualdade de todos, a problemática deve ser reposicionada, do domínio económico e político, para o plano familiar, cujo fundamento é a fraternidade. Isto porque, é no casal humano que está a origem do vínculo social, como se pode verificar nas interrogações sobre a igualdade da mulher ou o estatuto do embrião. Por último, o artigo aborda a contribuição da religião à reflexão sobre a articulação igualdade/identidade. Palavras-chave : direito natural, direitos humanos, discriminação, embrião, família, laicidade, marxismo, nazismo Abstract With the principle of equality it is intended to recognized the rights that are inherent to every human being, regardless their personal characteristics. On the other hand, the principle of identity emphasizes the distinctive differences between individuals. However, it is dangerous to oppose these two values , because the overlap of equality against identity (marxism), or identity against equality (nazism), has led to barbarism. Consequently, to overcome this tension and articulate everyone’s freedom with equality for all, the problematic must be repositioned, from the economic and political level, to the family sphere, whose foundation is kinship. Because the origin of the social bond lies in the human couple, as can be seen in questions about gender equality or the status of the embryo. Finally, the article discusses the contribution of religion to reflection on the articulation of equality/ identity.
